FOR PATIENTS: You understand and agree that Diagnosis+ will disclose the information you provide to us through the App to third parties, including, but not limited to, your health care providers in order to provide assistance in the health care services you receive. You hereby warrant that you consent and authorize our use and disclosure of any and all of your personal information and protected health information, including, to the extent such information exists, HIV/AIDS infection and/or testing information, genetic information, sexually transmitted disease information, mental/behavioral health, and/or substance use disorder diagnosis or treatment information. You understand that your health information is protected under federal privacy laws and regulations and under state law and cannot be disclosed without your consent except as otherwise specifically provided by law. Your consent will expire upon your termination of your Diagnosis+ account. You may revoke your consent at any time by notifying Diagnosis+ in writing. However, any previously disclosed information would not be subject to your revocation request because once the health information is released by Diagnosis+ it may be re-released by the recipient of the information and no longer protected by law or this Privacy Policy. You further understand that in order to access and use the App and our services you must agree to our Participation Agreement and complete an Authorization Form. Information We Collect
In operating our App, we may collect and process the following data about you:
- Details of your visits to our App and the resources that you access, including, but not limited to, traffic data, location data, weblogs and other communication data, including your IP address, the date and time you accessed or left the App, and which content you viewed. Some parts of our App use cookies and other technologies to collect this information about your general internet usage. See section below ‘How We Use Cookies” to learn more.
- Information that you provide directly to us by filling in forms on our App, such as name and e-mail address to contact us.
- If you are a health care provider, we will collect your name, institution, NPI number, DEA number, email address, telephone number, business address, and any data you input into our App.
- If you are a patient, we will collect your medical history, social history, surgical history, family history, medications, allergies, signs and symptoms, pharmacy information, insurance information, emergency contact, date of birth, address, telephone number, email address, and any data you input into our App or communications you make through our App.
- Information provided to us when you communicate with us for any reason.
By submitting a telephone number to Diagnosis+ you agree that a representative of Diagnosis+ can contact you at the number you provide, potentially using automated technology (including texts/SMS messaging) or a pre-recorded message. Your consent is not an obligation to receive any of our products and/or services.
How We Use Cookies
A “cookie” is a piece of text which asks permission to be placed on your device’s hard drive. Once you agree, this cookie file is stored on the hard drive of your device. They help us and our affiliates to improve our App by collecting certain information. They present the content from our App in the most effective manner for you and your device.
Your browser should have the ability to decline cookies. Generally this can be done by activating the setting on your browser which enables you to decline the cookies. Please note that should you choose to decline cookies, you may be unable to access particular parts of our App.
We do not track our users across time or across websites or other mobile apps.
We do not use flash cookies on our App.
In addition, certain content or applications within the App or accessible from the App may be served by third parties that use cookies or other tracking technology to collect information about you. We do not and cannot control these third parties or how they may use cookies or other tracking technologies.
Use of Your Information
The information that we collect and store relating to you is primarily used to enable us to provide our services to you in the best possible manner. In addition, we may use the information for the following purposes:
- To provide you with information relating to our services and/or products;
- To fulfill or meet the reason you provided the information;
- To provide third parties with statistical information about the users of our App;
- To monitor and conduct an analysis of our App usage patterns;
- To respond to law enforcement requests and as required by applicable law, court order or governmental regulations;

- To fulfill our obligations and enforce our rights and remedies under contract and at law, including our agreement(s) with you;

- To conduct data analytics using de-identified patient data collected through the App.

Security
To secure your information, we have put in place commercially suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect and maintain on our App.
Nonetheless, the transmission of information via the internet is not completely secure and therefore we cannot guarantee the security of data sent to us electronically on our App, and transmission of such data is therefore entirely at your own risk. You are responsible for taking steps to protect your personal and health information against unauthorized disclosure or misuse, including without limitation by protecting your account log-in credentials from unauthorized use or disclosure.
Disclosing Your Information
Where applicable, we may disclose your personal information and/or health information to any affiliated business entities or third parties necessary to provide products and/or services to you. This includes, where applicable, our subsidiaries, our holding company and its other subsidiaries (if any), as well as third parties involved in the administration and operation of our products and/or services. - Where we sell any or all of our business and/or our assets to a third party, whether through bankruptcy proceedings or other sale or merger.

Third Party Websites
By accessing third party websites through our App, you are consenting to the terms and privacy policies of those websites. We do not accept any responsibility or liability for their policies whatsoever as we have no control over them, and their use and disclosure of your information may differ from the terms and conditions of this Privacy Policy.
Users Only of Legal Age of Majority
Our App is designed and intended for those who have reached the age of majority (18 years of age). By using our App, you affirm that you are at least 18 years of age or older. We are not liable for any damages that may result from a user’s misrepresentation of age.
No one under age 13 is authorized to submit or post any information, including personally identifying information, on our App. Under no circumstances may anyone under age 13 use our App. Parents or legal guardians of children under 13 cannot agree to these Terms on their behalf.
Governing Law
Our App, its content and its use as well as this Privacy Policy are governed by the laws of the State of Connecticut.
